Patient Terms of Use
Twenty Two Health LLC (22 RPM). Last updated November 2025.
1. Introduction
These Patient Terms of Use (“Terms,” “Agreement”) govern your use of the remote patient monitoring services offered by Twenty Two Health LLC, doing business as 22 RPM (“22 RPM,” “we,” “our,” or “us”), including:
- The 22 RPM mobile applications (iOS and Android)
- The 22 RPM clinician web dashboard
- The FDA-cleared medical devices provided to you
- Our communication tools, including SMS and email
- Any data transmission, storage, alerts, or monitoring services
By using our services, you agree to these Terms. If you do not agree, you must not use the 22 RPM system, devices, or applications.
These Terms are separate from our Privacy Policies, including our HIPAA Privacy Policy.
2. Not for Emergencies (Critical Disclaimer)
22 RPM IS NOT AN EMERGENCY SERVICE.
- Do NOT rely on 22 RPM for urgent or emergent medical needs.
- If you experience chest pain, difficulty breathing, fainting, severe symptoms, or any emergency:
CALL 911 IMMEDIATELY.
22 RPM does not monitor your readings in real time, does not provide medical diagnosis, and does not replace clinical judgment.
3. Use of Devices and Equipment
A. Ownership
All devices provided to you—including blood pressure monitors, pulse oximeters, ECG devices, and weight scales—are owned exclusively by 22 RPM.
You are receiving them on loan for use during your remote patient monitoring program.
B. Device Return
Upon discharge from the RPM program or at your provider’s request, you agree to:
- Return all devices in good condition
- Follow return instructions provided by 22 RPM or your clinic
Failure to return devices may result in applicable replacement fees.
C. Proper Use
You agree to:
- Use devices only as instructed
- Avoid modifying, tampering with, or disassembling them
- Keep devices clean, dry, and safe
- Not use devices for any purpose other than monitoring directed by your provider
4. Your Responsibilities as a Patient
You agree to:
- Use the devices as directed by your healthcare provider
- Take readings as scheduled
- Ensure your device stays charged and operational
- Report any device malfunction to your provider or 22 RPM
- Provide accurate and truthful information
- Keep your login credentials confidential
- Update your contact information as needed
- Notify us immediately if your device is lost or stolen
You are responsible for securing your own mobile phone, Wi-Fi, or Bluetooth devices used in connection with 22 RPM.
5. Permitted and Prohibited Use
A. You May Use the Service Only To:
- Transmit RPM readings to your provider
- Communicate with your clinic as directed
- Review your historical readings
- Receive RPM program notifications
B. You Are Strictly Prohibited From:
- Attempting to access another person’s data
- Sharing your login credentials
- Uploading false, misleading, or inaccurate readings
- Using automated or manual scripts to interfere with the system
- Attempting to reverse engineer, copy, or modify 22 RPM software
- Damaging, altering, or tampering with RPM devices
- Attempting to bypass security controls
- Using the system for any unlawful purpose
Violation of prohibited uses may result in immediate termination of access.
6. No Medical Advice
22 RPM:
- Does not diagnose conditions
- Does not treat medical conditions
- Does not provide medical advice
- Does not replace a healthcare provider
- Does not monitor your data continuously or in real time
- Is not responsible for clinical decisions made by your provider
Your healthcare provider is solely responsible for reviewing your data and making medical decisions.
7. Communications & SMS Consent
By participating in a 22 RPM program, you consent to receive:
- Automated text messages
- Device reminders
- Measurement alerts
- System updates
- Program communications
Messages may be sent via Twilio or similar HIPAA-compliant services.
You may opt out of non-essential messages by replying “STOP,” but doing so may impact the effectiveness of monitoring.
8. Billing, Medicare, and Insurance Disclaimers
22 RPM bills CMS directly for remote patient monitoring services.
Depending on your insurance coverage:
- You may be responsible for co-pays, deductibles, or out-of-pocket costs
- RPM services may count toward your annual deductible
- Coverage varies by plan and insurer
22 RPM is not responsible for payment decisions made by Medicare or your insurance provider.
9. Software License
22 RPM grants you a limited, non-exclusive, non-transferable license to use the patient mobile application and dashboard solely for your personal medical monitoring.
You may not:
- Copy or redistribute the software
- Modify, decompile, or reverse engineer it
- Rent, sell, or sublicense it
10. Security and Data Privacy
Your Protected Health Information (PHI) is handled according to:
- HIPAA requirements
- Our internal security policies
- Encryption standards for data at rest and in transit
- Role-based access controls
Website-related personal information is governed by our separate Website Privacy Policy.
11. Service Interruptions
22 RPM does not guarantee:
- 24/7 uptime
- Real-time data transmission
- Error-free communication
- Uninterrupted network connectivity
You must contact your healthcare provider if readings fail to transmit or your device malfunctions.
12. Account Termination
22 RPM may terminate or suspend your access if:
- You misuse the devices or platform
- You violate these Terms
- You leave the RPM program
- Your provider requests termination
- We suspect unauthorized or harmful activity
13. Limitation of Liability
To the fullest extent permitted by law:
22 RPM is not liable for:
- Delays in data transmission
- Incorrect readings caused by user error
- Misuse or mishandling of devices
- Losses due to service outages
- Decisions made by healthcare providers
- Damages resulting from emergencies
- Any reliance on data displayed in the app
Our services are provided “as is” without warranties.
14. Indemnification
You agree to indemnify and hold harmless 22 RPM from any claims, damages, or losses arising out of:
- Your misuse of the devices
- False or inaccurate readings
- Unauthorized access
- Violation of these Terms
15. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
16. Changes to These Terms
We may update these Terms from time to time. Updated versions will include a revised “Last Updated” date. Continued use of the service indicates acceptance of changes.
